We sit down with each client to advise him or her of important Constitutional Rights. For example, we explain you have the right to a speedy, public jury trial where you would be presumed innocent, and you could not be convicted unless 12 impartial jurors were convinced of your guilt beyond a reasonable doubt.
You should also know about your right to confront and cross-examine all witnesses testifying against you, including police officers.
You should also know about your right to remain silent and not incriminate yourself, and the right to testify on your own behalf.
You should also know about your right to present evidence and to have the Court issue subpoenas to bring into Court all witnesses and evidence favorable to you.
Although we pride ourselves on winning jury trials, some circumstances dictate that the client should accept an offer from the prosecutor. In these cases, we inform our clients that by not taking your case to a jury trial, you are waiving or giving up the rights explained above. We advise our clients of the consequences of a plea of guilty or no-contest. For clients who are not citizens of the United States, a plea of guilty or no-contest could result in your deportation, exclusion from admission to this country, or denial of naturalization.
For DUI cases, we advise clients that the Department of Motor Vehicles may consider any of your other convictions for DUI or reckless driving, even those that are not charged in this proceeding, and may impose a more severe license restriction, suspension, or revocation as a result. The court may also impound your vehicle at your expense for up to 90 days, unless it is in the interests of justice not to do so. The court may also declare your vehicle to be a nuisance and order it sold following a hearing if you have 2 or more other convictions for DUI, vehicular manslaughter or any combination.
If you have to pay a fine, the Court will add assessments which will significantly increase the amount you must pay.
The court may also require you to install an ignition interlock device (IID) for up to three years. For driving on a suspended license cases, we explain that if you plead guilty or no-contest to a second or subsequent violation of driving with a suspended or revoked license or driving without a license, your vehicle will be subject to forfeiture as a nuisance.
If, after consulting with your Southern California DUI lawyer, you decide that a jury trial is the way to go, you will have the peace of mind that your lawyer, Richard Wagner, will be thoroughly prepared, having investigated and prepared your case to the fullest extent. We encourage our clients to become active participants in their cases. Therefore, case preparation consists of additional meetings with you, your witnesses, if any, and possibly visiting the scene where the alleged drunk driving took place.
As you and your Southern California DUI lawyer work together in preparing your case, you will usually be presented with a very good settlement from the prosecutor, making a jury trial unnecessary.
