|  | :: EXPUNGEMENTS :: In many situations clients seek relief from the civil consequences of criminal records. We help clients apply for postjudgment action by the court, such as sealing records or vacating convictions. We determine what the civil consequences of criminal records are and what relief and under what circumstances, will ultimately be available. For example we explain whether you can be relieved of the duty to admit a conviction on employment applications or whether you will receive professional discipline.
Often times clients are entitled to relief from arrest records under the Penal Code and found factually innocent (no reasonable cause exists to believe that you committed the offense). For felony convictions and cases in which the court granted probation without the imposition of sentence, we help file your application with the court for the charge to be reduced to a misdemeanor. We advise clients which offenses qualify for this treatment and the exceptions that apply. For clients who have successfully completed probation, we file requests asking the court to set aside the jury verdict of guilty, for permission to withdraw the guilty or no contest plea, order the not-guilty plea reinstated and dismiss the accusation or information. We also help you file before probation ends in cases where the court determines that it is in the interest of justice.
For clients who have been convicted of a non-violent drug possession charge and have received probation and successfully completed drug treatment, we generally recommend that the client file and serve a petition for a dismissal under Penal Code section 1210.1(d). If the court finds that the client has successfully completed treatment, the court should dismiss the case. We advise clients of the relief to be gained when the petition is granted and the applicable exceptions.
